Measures for the Protection and Management of Geosites in Keketuohai UNESCO Global Geopark

Chapter I. General provisions

Article 1 In order to strengthen the management of the geosite in Keketuohai UNESCO Global Geopark, and to ensure its effective protection and rational use, these Measures are formulated in accordance with relevant laws and regulations, such as the Environmental Protection Law of the People's Republic of China, the Mineral Resources Law of the People's Republic of China, the Regulations on the Nature Reserves of the People's Republic of China, the Wetland Conservation Law of the People's Republic of China, the Provisions on the Administration of Protecting Geological Monuments (Decree No. 21 of the former Ministry of Geology and Mining), the Regulations on the Protection of Paleontological Fossils, the Measures for the Implementation of the Regulations on the Protection of Paleontological Fossils, and the Regulations on the Geological Environmental Protection in Xinjiang Uygur Autonomous Region. Regulations on the Protection of Paleontological Fossils, Measures for the Implementation of the Regulations on the Protection of Paleontological Fossils, Regulations on the Protection of the Geological Environment of the Xinjiang Uygur Autonomous Region, and other relevant laws and regulations, and formulate the present measures in the light of the reality.

Article 3 Geosite, as referred to in these Measures, refers to the precious and non-renewable geological and natural heritage that has been formed, developed and left behind as a result of various internal and external dynamics of geological action during the long geological historical period of the earth's evolution.

Article 4 The scope of Keketuohai UNESCO Global Geopark referred to in this method: bounded in the north by the natural boundary of the Karadurgen River-Buyetsay-Kuste River-South Slope of Kunchalharn-3234 Peak, in the east by the county administrative boundary of Fuyun and Qinghe counties, in the south by the natural boundary of the west bank of Karashengeer-Ergelatay River-Ergelatay-The Second Plant-Lhokaiyilok, and in the west by the natural boundary of the Kayileke-Maizengsayi-Sayihengbulake- Alasan-Karadurgen River natural boundary as the boundary, formed by 268 boundary points of inflection circle, including the Irtysh Grand Canyon, Sayihengbulake, Kalaxiangeer, Kekesuli, No.3 mines, covering an area of 2,337.90 square kilometres.

Article 5 The protected geosite is a valuable asset of the state, and no unit or individual shall destroy, excavate, buy, sell or otherwise transfer the geosite and mobile geomorphological landscape geosite.
Article 6 The protection of geosites is part of environmental protection, and the principle of "active protection and rational development" should be implemented to maintain their originality, naturalness, integrity and authenticity.

Chapter II. Contents of protection of geosite

The following geosite in the Geopark shall be protected in accordance with law:

(i)Variscan period and the Yanshanian period granite landforms composed of altaic granite landforms with significant scientific research value and ornamental value, is an important part of China's granite landforms, for the continental cold temperature and arid climate zone of the granite landforms typical representative of the land and the standard comparative study site;

(ii)Keketuohai area pegmatite-type rare metal deposits found as many as 86 kinds of minerals, No. 3 Mine magnificent and unique deposit form and its complete pegmatite geochemical evolution and rich rare metal mineralisation, etc. has a significant scientific research value and ornamental value, is the basis of modern mineral crystallography and granite pegmatite deposits the theory of the emergence of the Chinese and foreign scientists for the study of granitic pegmatites and rare metal mines of the classical The area;

(iii)Kalaxiangeer area is preserved with seismic fissures, seismic collapse zones, seismic fracture grooves, seismic steep cans, seismic brow ridges, fracture plug ponds, drums, active fractures and other seismic relics formed by the Fuyun magnitude 8 earthquake, seismic fault zones are of the nature of the right-handed strike-slip, the special dynamic characteristics and the mechanism of seismicity have significant scientific research value and ornamental value, and it is the best seismic fracture zones relics on-site museums at home and abroad, and a classic place for the study of active seismic fault zones in the country. It is the best museum of earthquake fault zones at home and abroad, and a classic place for the study of active earthquake fault zones in China;

(iv)The park is the source of the Irtysh River, Yileimu Lake and Kekesuli are lakes formed by water accumulation in the seismic fracture basin, with excellent ecological environment, a paradise for animals to live and breed, and an indispensable resting station on the migratory corridor of migratory birds in the Middle East and Central Asia, which is of great scientific research value and ornamental value;

(v)Altay Mountain is the only mountain range in China where modern glacial landforms are formed by the cold airflow from the Arctic Ocean. Although there are no modern glacial landforms developed in the Geopark, there are glacial landforms such as angular peaks, edged ridges, ice buckets, U-shaped valleys and glacial lakes, which are formed by the cold climate of the Arctic Ocean, and they are of important scientific research and ornamental value;

(vi)Other geosite in need of protection.


Chapter III Construction of Protected Areas for Geosites

Article 11 To implement hierarchical zoning protection for the areas where geological remains such as world-class, national and provincial geoparks are located, with a total area of 321.4 square kilometres of protected areas for geological remains, and the establishment of first-, second- and third-level protected areas for geological remains, of which the first-level protected area covers an area of 1.78 square kilometres, the second-level protected area covers an area of 64.47 square kilometres, and the third-level protected area covers an area of 227.18 square kilometres.

Article 14 Boundary pillars shall be buried on the boundaries of protected areas for geological relics at all levels, and signboards shall be set up to mark the scope, boundaries and protection contents of the protected areas. For typical geological relics under key protection, measures such as setting up fences and special guards shall be taken to carry out closed protection and management. No unit or individual shall move or change the boundary pillars, signboards, fences and other facilities of the protected area without permission.

Article 15 Protected areas for geosites shall be established taking into account the integrity of the objects to be protected as well as the needs of local economic construction and the production and living of the population.

Chapter IV. Management of protected areas for geosites

Article 16 It is prohibited to engage in the following activities within the protected area of the geopark:
a. Construction of buildings and engineering facilities that may cause damage to the geosite in violation of regulations;
b. Farming, planting, sand dredging, quarrying, earth extraction, mountain clearing, land clearing, blasting and logging in violation of regulations;
c. Damaging and excavating geosite, collecting, acquiring, processing and selling products and articles of geosite such as geological specimens, strange stones, ornamental stones and fossils in the Geopark without approval, or transporting the said products and articles out of the Geopark;
e. Illegally carrying out mineral resources exploration and development activities;
f. Altering the state of natural water system by enclosing or filling up rivers, springs and waterfalls;
g. Unauthorised collection of wild plants under national and provincial key protection;
h. Unauthorised capture of wild animals under national and provincial key protection;
i. Introducing or releasing foreign species;
j. Bringing into the Geopark animals and plants that are quarantined as disease-ridden, pest-ridden or contaminated, as well as their packaging materials and means of transport;
k. Using highly toxic, highly toxic or highly residual pesticides, discharging sewage, throwing away and piling up waste and rubbish at will;
l. Carving and painting indiscriminately, damaging or destroying the protection, service, excursion, public transport facilities and other facilities;
m. Establishment of any form of industrial development zone;
n. Construction of villas, real estate projects, training centres, sanatoriums and other buildings;
o. Other acts of destroying the landscape of geosite.

Article 17 Protection requirements of protected areas at all levels: Grade I protected areas can set up necessary trails and related facilities, but must be coordinated with the landscape environment, strictly control the number of tourists and prohibit the entry of motorised transport; Grade II protected areas are allowed to set up a small number of geotourism service facilities that are coordinated with the landscape environment, and shall not arrange for buildings affecting the landscape of the geosite, and the number of tourists shall be reasonably controlled; Grade III protected areas can set up a moderate amount of geotourism service facilities that are coordinated with the landscape environment, and shall not arrange for large-scale buildings such as halls and amusement facilities. Tertiary protected areas can set up a moderate amount of geological tourism service facilities that are in harmony with the landscape environment, and shall not arrange large-scale buildings such as halls, amusement facilities and so on.

Article 18 No new construction, alteration or expansion of geotourism service facilities shall be permitted within the scope of the first-level protected area, and the construction activities of the protection works shall be coordinated with the landscape environment, and the following protection and management measures shall be implemented:
a. With the approval of the administrative department of the Geopark, scientific research, teaching, academic exchanges and tourism activities may be carried out in an organised manner;
b. Scientifically calculate the capacity of the ecological environment and prepare contingency plans for tourists exceeding the limit;
c. Based on the planning of the Geopark, set up tour trestles in a scientific and reasonable manner, strictly control the scope of construction, keep away from the geosite, and strictly prohibit the construction of motor vehicle roads;
d. Regular or irregular maintenance and repair of the tour or protection facilities within the scope;
e. No tourist accommodation service beds shall be arranged in the geological tourism facilities;
f. The protection work is implemented by the person responsible for the director of the Management Committee of Xinjiang Fuyun Keketuohai National Geopark;
g. A weekly inspection system shall be implemented for the important geosite in the primary protection area, and inspection by means of drones and construction of video surveillance may be adopted for remote or barren uninhabited areas;
h. Other provisions of laws, regulations and rules.


Article 19 There are restrictions on the construction of new, altered and expanded geotourism service facilities within the scope of the secondary protected area, and the construction activities of the protection works shall be coordinated with the landscape environment and the following protection and management measures shall be implemented:

a. With the approval of the administrative department of the Geopark, scientific research, teaching, academic exchanges and tourism activities may be carried out in an organised manner;
b.  Scientifically calculate the capacity of the ecological environment and prepare contingency plans for tourists exceeding the limit;
c. Buildings and structures that affect the landscape of the geosite shall not be constructed;
d. No tourist accommodation service beds shall be arranged in the geological tourism service facilities constructed;
e. There are restrictions on allowing motorised transport to enter;
f. The construction of walking trails and motorised roads is strictly prohibited to damage the geosite, and the scope of construction is strictly controlled and kept away from the geosite;
g. The geopark's geo-hazard hazard sites are always monitored, and geo-hazard management works are not allowed to damage geosite and the construction scope is strictly controlled;
h. It is strictly prohibited to discharge sewage, pile up wastes and rubbish into the water bodies of Yileimu Lake and Kekesuli, and it is strictly prohibited to illegally breed in Yileimu Lake and Kekesuli Lake, as well as to graze livestock and clear land around the lake;
i. The protection work is carried out by the person responsible for the deputy director in charge of geosite protection of Management Committee of Xinjiang Fuyun Keketuohai National Geopark ;
j.  An inspection system is implemented twice a month for the important geosite in the secondary protection area;
k. Other provisions of laws, regulations and rules.

Article 20 The appearance of the geotourism service facilities constructed within the scope of the third-level protected area shall be coordinated with the surrounding nature, geosite, and humanistic landscapes, reflecting the local cultural traditions and national characteristics, and shall not carry out construction activities unrelated to scenic tours and enjoyment, and shall implement the following protection and management measures:

a. Prohibit the illegal construction of tour facilities, repair of graves and erection of monuments in the tertiary protected areas, and strictly prohibit the opening of visits and tourism projects that are inconsistent with the direction of geopark protection;
b. Scientifically calculate the capacity of the ecological environment and prepare contingency plans for tourists to exceed the limit;
c. Always monitor the geological disaster hidden spots in the Geopark, and the geological disaster management project shall not destroy the geosite, and strictly control the construction scope;
d. The protection work is implemented to the person, the responsible person is the director of the Mining Geopark Administration of Management Committee of Xinjiang Fuyun Keketuohai National Geopark ;
e.  An inspection system is implemented once a month for the important geosite in the three-level protection area;
f. Other provisions of laws, regulations and rules.

Article 26 Anyone who collects geological specimens, fossils or conducts experiments and other scientific research activities in the Geopark shall submit an application to the Geopark's management body, and shall also consult the competent administrative department of the Forestry and Grassland Department for projects that may have significant social impacts, and shall carry out the activities within the designated routes and scopes after submitting them to and obtaining approval in accordance with the regulations.
Article 27 All units, residents, students and tourists in the Geopark must abide by the management system of the Geopark and consciously accept the management of the Geopark administration.

Chapter V. Legal liability

Article 32 In case of violation of the relevant provisions of these Measures, the management body of the Geopark may, in accordance with the relevant provisions of the Regulations of the People's Republic of China on Nature Reserves, depending on the different circumstances, give a warning, impose a deadline for rectification, impose a fine, confiscate the illegal gains and order compensation for the losses; in case of constituting a crime, it shall be handed over to the judicial organs to be investigated for the criminal responsibility in accordance with the law.

Article 33 The competent forestry and grassland administrative department shall strengthen the supervision and inspection of the protection and management of the geopark, and urge the management agency of the geopark to implement the protection measures. If a geopark management agency violates the provisions of these Measures, the competent forestry and grassland administrative department shall, in accordance with the relevant provisions, order rectification within a certain period of time and impose penalties in accordance with the law.
